RESPONSIBILITY, SCOPE AND APPLICATION OF TERMS AND CONDITIONS

These Terms and Conditions (hereinafter referred to as the “Terms”) apply to the third-party authentication process for goods that you, as a Bazatify Vendor, intend to list for sale through Bazatify. As part of the Bazatify program, we provide a means to authenticate certain items through a third-party service provider; Real Authenticator (“RA”). RA is a group of independent, third-party authenticators. RA is not affiliated with nor an agent of Bazatify.   • Once authenticated by RA, Bazatify does not represent, warrant or guarantee that the product is authentic. The purpose of authentication is to ensure that the standards of conformity for the product are met. Additionally, Bazatify does not provide a money-back guarantee, Instead, the vendor will be responsible for the products they sell, regardless of how RA determines authenticity. Bazatify does not indemnify the vendor, buyer or any other consumer or customer against subsequent claims. Some items are eligible for a Certificate of Authenticity (certificate) from RA, which can be purchased for an additional fee.
  • Some categories of items that complete RA’s Authentication process are not eligible for certification. While these items meet the standards of authenticity through the authentication process, they will be required to be inspected in person to qualify for certification and are not currently available through RA. The level of service is determined by RA and depends on the category of item being considered.
  • RA’s services are limited to providing an independent opinion regarding the authenticity of an item submitted by a vendor (e.g. whether the item is counterfeit, fake, replica, homemade, or produced by any entity other than the brand it claims to be) and providing certificates upon request and/or upon purchase for eligible items. Neither RA nor Bazatify holds the item as part of the authentication process.
  • Bazatify has no input, position, or responsibility regarding the authenticity determination made by RA. RA is not an agent of Bazatify. Bazatify does not hold any ownership of the item being authenticated and/or sold at any time. The only information that Bazatify passes to RA is a photograph and the vendor ID (a unique number used to identify the vendor, which has no meaning outside of this process).
  • Neither Bazatify nor RA are affiliated with or endorsed by any brand being authenticated, sold or processed through RA Authenticate.
  • Bazatify’s Terms of Service, Privacy Policy and other agreements continue to apply, in addition to these Bazatify Authenticate Terms and Conditions, which specifically apply to the authentication process performed by RA. If not otherwise stated herein, the terms set forth in the Bazatify Terms of Service or the relevant agreement shall apply. Terms not defined herein shall have the meanings set forth in the Bazatify Terms of Service.

THE AUTHENTICATION PROCESS

  • Authentication Agent (“RA”) is the third party responsible for authenticating your item. Bazatify does not express any opinion, assume any role in, or assume any responsibility for the authentication of any item or the results thereof by RA.
  • RA is an independent third party providing authentication services. They are not affiliated or partnered with any of the brands for which they provide these services.
  • For most vendors, listing your product using the Authenticate service on Bazatify is optional. However, in some cases, your item MUST use the Authentication service. For example, if the listing price exceeds a certain dollar threshold or for certain brands.
  • If a vendor chooses to Authenticate or the item MUST use the Authentication service to be listed on the Bazatify platform, the vendor will follow the same process described in the next section.
  • If, based on price, category, or other factors, completing the Authentication service is required to list the item and the user intentionally avoids this process in any way, their account may be suspended or closed.

AUTHENTICATION PROCESS

  • Whether your item requires Authentication to be listed on Bazatify or you opt in, the experience is the same.
    • Once you’ve finished creating your listing, after tapping “Listing,” a series of Authentication tutorial pages will appear, guiding you through the process.
    • These pages will provide you with additional information about what you need to do and what you can expect when authenticating your product, such as category, price, and time to make a decision.
    • Take a photo of your product following the instructions below. Doing so will help speed up the review process.
      • Copyright/Legality. When submitting photos for authentication (or for listing):
        • These must be photos taken by YOU.
        • DO NOT use publicly available photos or photos from the Brand’s website or ads.
        • You must take photos of the actual product you are listing.
      • Image Quality:
        • Must be clear and close-up.
        • Use natural light to reduce blur and capture details.
        • Providing high-resolution images will help speed up the RA verification process.
      • Image Content.
        • For all item categories, you must submit all photos required by Bazatify in the listing stream. This may include photos such as:
        • Front
        • Back
        • Logo
        • Serial number or code
        • Hardware engraving
        • “Made in” tag
      • During the authentication process, the potential statuses are:
        • Pending review – RA is still reviewing
        • Need more information – User needs to provide more information

CATEGORIES AND BRANDS

The Authenticate service is limited to certain categories as listed by RA, please refer to this page for more details. BAZATIFY RESERVES THE RIGHT TO MODIFY THIS LIST AT ANY TIME.

TIMELINES

In most cases, RA will provide you with a decision on the authenticity of the item within 24 hours. RA may request additional photos to make a final decision. Time does not begin to accrue until RA has received all required images and the images are clear enough.

FEES

You will pay the fee directly to RA, Bazatify does not charge for this authentication.

OUTCOMES FROM THE AUTHENTICATION PROCESS

  • Potential outcomes after third-party authentication are:
    • If RA determines your item is authentic, you will be provided with a virtual “authenticity badge” that can be displayed on your item listing. This badge can only be used for items that have been verified by RA and are only available on Bazatify.
    • The authenticity badge does not indicate that the vendor has been verified, it is specific to the luxury item whose images were submitted and is only available for that specific item.
    • Bazatify does not have the ability to change, edit, or award the authenticity badge. The badge is not issued by Bazatify and any decisions regarding it are at the sole discretion of RA, as a third party authenticator.
  • “Rejected”: RA determines the product is not authentic or is not valid for the brand it is advertised for.
  • “Inconclusive”: RA is unable to determine authenticity.
    • An item may be reviewed by Bazatify for a second chance to be listed. However, even if it is determined to be authentic, the item will not receive an authentication badge.
    • You may list your product elsewhere (other than Bazatify) if RA is unable to authenticate.
